Police: 2 found squatting in vacant apartment, man also charged with heroin possession

Two Minot residents were charged with trespassing Wednesday evening after police found them allegedly squatting in a northwest apartment that is supposed to be vacant. Justin Mack, 35, and Amber Nicole Blunt, 21, were scheduled to make appearances in district court in Minot Thursday on the charge. In addition, Mack is charged with drug offenses after police found suspected heroin and drug paraphernalia on his person.

Mack is charged with Class A misdemeanor trespass, Class C felony possession of heroin and Class C felony possession of drug paraphernalia. Blunt is charged with Class A misdemeanor trespass.

According to probable cause affidavits filed in the case, Mack and Blunt were found sleeping on an air mattress upstairs in the apartment after someone called police and complained that Mack and Blunt had threatened her. Police then contacted the apartment management company, learned the apartment was supposed to be unoccupied and obtained permission to clear out the apartment, according to the probable cause affidavit filed with the court.

Mack reportedly had a small white plastic tube inside one of his pockets with suspected drug residue on him and a small plastic bag containing about 3 grams of suspected heroin and a piece of crumbled tin foil with burned trail marks on it.

Multiple petitions have been filed to revoke Mack’s probation on drug-related convictions.

His lawyer, Raissa Carpenter, told Judge Doug Mattson that Mack’s probation officer has apparently been working to get him to treatment and the concern has been that Mack hasn’t followed through.

Mack told Mattson at his initial appearance on Thursday that he has been attending the methadone clinic in Minot.

“Well, that puppy ain’t working,” Mattson remarked.

A preliminary hearing for Mack on the latest felony charges has been scheduled for Feb. 15 in district court in Minot. A pre-trial conference on the misdemeanor criminal trespass charge is scheduled for April 25.

Mattson ordered Mack and Blunt to stay away from the apartment and to have no contact with the owners of the apartment complex if they make bond.
