Man charged with having sex with runaway 14-year-old
A Minot man is charged with having sex and doing drugs with a runaway 14-year-old girl last January.
Elias David Galicia, 24, is charged with Class AA felony gross sexual imposition and could face up to life in prison without parole if convicted.
Galicia was 23 at the time of the alleged offense. The girl, whose birth year is given as 2002 in court documents, ran away from her home on the evening of Jan. 30. Police investigated and found that she had received emails from adult dating sites such as plenty of fish.com, adult friend finder and meet me. The girl told authorities that her online dating profile said she was “17 going on 18.” She also told Galicia that she was “17 going on 18.”
She received messages from Galicia, including one making arrangements for Galicia to pick up the girl at her trailer court at 11:30 p.m. on Jan. 30. In March, the girl told authorities that she and Galicia then went back to his trailer in a different trailer court. The girl smoked marijuana and snorted methamphetamine with Galicia and with a friend of his. She later had sex with Galicia. Afterwards, she “hung out” with Galicia watching videos, playing video games, doing meth and smoking marijuana. Galicia’s roommate gave the girl a ride to the library on Feb. 1 and she then called one of her friends and asked for a ride home.
A prosecutor said Galicia has a previous conviction for contributing to the delinquency of a minor. According to a probable cause affidavit filed with the court, the offense took place in July 2012, when Galicia was 19. Galicia was originally charged with corruption of a minor. He was alleged to have had sex with a 15-year-old girl and to have known that she was 15. He pleaded guilty to the different Class A misdemeanor charge in June 2014, nearly two years later, and was sentenced to unsupervised probation and ordered to pay fines.
Judge Todd Cresap set bond at $75,000 cash or corporate surety for Galicia during his initial appearance on Wednesday on the gross sexual imposition charge.
Galicia asked for a court appointed lawyer. A preliminary hearing in the case is set for Jan. 19.
